PERLINDUNGAN HUKUM BAGI KORBAN PENIPUAN JASA TITIP (JASTIP) MELALUI MEDIA SOSIAL DALAM PERSPEKTIF HUKUM PERDATA

Perkembangan teknologi informasi dan media sosial telah menyebabkan peningkatan transaksi digital, termasuk layanan jasa titip (jastip), yang semakin populer di kalangan masyarakat umum karena kemudahan dan efisiensinya dalam membeli barang. Namun, perkembangan ini juga memunculkan sejumlah permasalahan hukum, salah satunya adalah penipuan jasa titip melalui media sosial yang menimbulkan kesulitan bagi konsumen. Tujuan dari penelitian ini adalah untuk menganalisis jenis perlindungan hukum bagi korban penipuan jasa titip melalui media sosial dan tanggung jawab hukum pelaku berdasarkan perspektif hukum perdata. Metodologi penelitian yang digunakan adalah penelitian kualitatif dengan menggunakan studi kepustakaan melalui pemeriksaan literatur, buku, jurnal ilmiah, dan peraturan yang relevan. Hasil penelitian menunjukkan bahwa hubungan hukum antara penyedia jasa titip dan konsumen merupakan hubungan kontraktual berdasarkan Pasal 1320 KUHPerdata. Apabila pelaku tidak memenuhi kewajibannya sesuai perjanjian, maka dapat dikategorikan sebagai wanprestasi dan wajib memberikan ganti rugi kepada konsumen. Perlindungan hukum juga diberikan melalui Undang-Undang Perlindungan Konsumen dan Undang-Undang Informasi dan Transaksi Elektronik. Meskipun demikian, efektivitas perlindungan hukum masih menghadapi kendala berupa sulitnya identifikasi pelaku, lemahnya pengawasan media sosial, serta rendahnya literasi hukum dan digital masyarakat.
Advances in information technology and social media have led to an increase in digital transactions, including shopping proxy services (jastip), which are becoming increasingly popular among the general public due to their convenience and efficiency in purchasing goods. However, this development has also given rise to a number of legal issues, one of which is fraud involving shopping proxy services via social media, which causes difficulties for consumers. The objective of this study is to analyze the types of legal protection available to victims of shopping agency fraud via social media and the legal liability of the perpetrators from a civil law perspective. The research methodology employed is qualitative research utilizing a literature review through the examination of relevant literature, books, scientific journals, and regulations. The research findings indicate that the legal relationship between the proxy service provider and the consumer constitutes a contractual relationship under Article 1320 of the Civil Code. If the perpetrator fails to fulfill their obligations as stipulated in the agreement, this constitutes a breach of contract, and they are obligated to compensate the consumer. Legal protection is also provided through the Consumer Protection Act and the Electronic Information and Transactions Act. Nevertheless, the effectiveness of legal protection still faces challenges, including the difficulty in identifying perpetrators, weak oversight of social media, and low levels of legal and digital literacy among the public.
