PENGAWASAN DINAS TENAGA KERJA DAN TRANSMIGRASI PROVINSI RIAU TERHADAP PENEMPATAN DAN PELINDUNGAN PEKERJA MIGRAN INDONESIA TAHUN 2024

Abstrak

Pekerja Migran Indonesia menghadapi banyak persoalan terkait penempatan dan pelindungannya yang memerlukan pengawasan dalam prosesnya. Dalam hal ini, pemerintah berwenang dalam mengatur, membina, melaksanakan dan mengawasi penyelenggaraan penempatan Pekerja Migran Indonesia. Disinilah perlu adanya peran Dinas Tenaga Kerja dan Transmigrasi Provinsi Riau sebagai pengawas ketenagakerjaan di tingkat pemerintah dareah provinsi berdasarkan Pasal 92 Ayat (2) Peraturan Pemerintah Nomor 59 Tahun 2021. Jenis penelitian ini adalah penelitian hukum empiris atau sosiologis, yaitu penelitian yang diperoleh secara langsung dari masyarakat atau penelitian data primer. Penelitian ini bertujuan untuk menemukan konsep-konsep mengenai proses terjadinya hukum dan proses bekerjanya hukum di masyarakat. Berdasarkan hasil penelitian, pengawasan yang dilakukan oleh Dinas Tenaga Kerja dan Transmigrasi Provinsi Riau belum sepenuhnya berjalan dengan optimal. Hal ini disebabkan kurangnya pengetahuan masyarakat tentang prosedur menjasdi pekerja migran, jalur perekrutan ilegal yang masih banyak, kurangnya anggaran untuk pengawasan yang efektif serta belum adanya peraturan daerah yang mengatur. Sehingga pelaksanaan pengawasan belum sepenuhnya dapat menurunkan jumlah pekerja migran ilegal.

Indonesian Migrant Workers face many issues related to their placement and protection that require supervision in the process. In this case, the government has the authority to regulate, foster, implement and supervise the implementation of the placement of Indonesian Migrant Workers. This is where the role of the Riau Province Manpower and Transmigration Service is needed as a labor supervisor at the provincial government level based on Article 92 Paragraph (2) of Government Regulation Number 59 of 2021. This type of research is empirical or sociological legal research, namely research obtained directly from society or primary data research. This research aims to find concepts regarding the process of law and the process of law working in society. Based on the research results, supervision carried out by the Riau Province Manpower and Transmigration Office has not been fully implemented optimally. This is due to the lack of public knowledge about the procedures for becoming a migrant worker, the many illegal recruitment channels, the lack of budget for effective supervision and the absence of regional regulations that regulate it. So that the implementation of supervision has not been able to fully reduce the number of illegal migrant workers.
