POLITIK HUKUM TERHADAP KEBERADAAN HUKUM ADAT DITENGAH MASYARAKAT

(STUDI MASYARAKAT HUKUM ADAT KABUPATEN BUNGO)

Abstrak

In the lives of the people of Bungo District who still adhere closely to traditional norms in their daily lives, the existence of traditional institutions as an alternative dispute resolution has an important and decisive position. Apart from that, traditional elders are also a reference for choosing leaders in political contestations. Even in modern life like today, traditional institutions are still respected and recognized for their existence to this day. The specification of this research is normative legal research. Customary law is original Indonesian law that is not written in the form of legislation of the Republic of Indonesia, which contains religious elements. It can also be said that Customary Criminal Law is original Indonesian law that is not written in the form of legislation that contains religious elements, followed and obeyed by society continuously, from one generation to the next. Violation of the rules and regulations is seen as being able to cause upheaval in society. Communities in hamlets or villages in the Bungo Regency area always prioritize deliberation in every activity, especially in matters related to resolving disputes or disputes, so that every problem that occurs in the community always involves the role of traditional leaders in resolving it, this is a reflection of the existing customs. They have applied it from the past, where every dispute always uses peace efforts through mediation and is followed by customary sanctions that must be fulfilled by the perpetrator who has violated it. Political dynamics in the Jambi Malay traditional institution, Bungo Regency, have a great influence on the indigenous community in Bungo Regency because this community is very obedient to the traditional elders who are called "Datuk Adat Rio" in each area so that when the traditional elders say this to the community it becomes an order but it is not written down so What the traditional leader says is what the community will automatically follow.
