KEDUDUKAN POLITIK HUKUM SEBAGAI CABANG ILMU PENGETAHUAN DALAM LINGKUNGAN DISIPLIN ILMU HUKUM

Abstrak

Basically, the meaning of legal politics is defined differently by experts, although these differences do not show significant differences, but basically experts define legal politics as a policy made by the government as a foothold or basis for determining the direction of national legal development in in order to achieve Indonesia's goals. The problem formulation in this research is the position of legal politics as a branch of knowledge within the legal discipline environment. The aim of this research is to determine and analyze the position of political law as a branch of knowledge within the legal discipline environment. This research was prepared based on normative legal research. The term legal politics was introduced in Indonesia for the first time by Soepomo in 1947, through his writings in Hoekoem Magazine in an article entitled "Hoekoem Political Problems in the Development of the Indonesian State". Politics is a field in society that is related to the goals of that society. The presence of Political Science and Law as a branch of science or as a new scientific discipline increases the number of branches of science that study law from a non-juridical perspective (point of view) which takes its starting point from certain optics that were born earlier. The term legal politics in the sense of legal policy determined by the state or government (ruler or authorized state organ). Political and legal studies include at least 3 things, namely; First, state policy (official line) regarding laws that will be enforced or not enforced in order to achieve state goals. Second, the political, economic, social, cultural background for the birth of legal products. Third, law enforcement in reality on the ground.
