Abstrak

Tujuan penelitian ini adalah untuk menganalisis efektivitas penerapan sistem E-Court dalam penyelesaian perkara perdata di Indonesia serta mengidentifikasi faktor-faktor penghambat dan kekurangannya dalam praktik peradilan. Permasalahan utama yang dikaji meliputi sejauh mana sistem E-Court mampu mewujudkan asas peradilan sederhana, cepat, dan biaya ringan, serta bagaimana hambatan teknis dan yuridis yang muncul dalam penerapannya.Perkembangan teknologi informasi yang pesat telah mendorong transformasi digital di berbagai sektor, termasuk dalam sistem peradilan di Indonesia. Mahkamah Agung RI menerapkan sistem E-Court sebagai inovasi untuk meningkatkan efisiensi, transparansi, dan akses terhadap keadilan melalui proses administrasi dan persidangan elektronik. Namun, pelaksanaan sistem ini masih menghadapi berbagai kendala, seperti keterbatasan sumber daya manusia, infrastruktur teknologi, serta belum meratanya pemahaman masyarakat terhadap sistem digital.Metode penelitian yang digunakan adalah yuridis normatif empiris, dengan pendekatan perundang-undangan (statute approach). Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan yang relevan seperti PERMA Nomor 3 Tahun 2018, PERMA Nomor 1 Tahun 2019, dan PERMA Nomor 7 Tahun 2022, serta melalui studi kasus terhadap pelaksanaan E-Court di beberapa pengadilan negeri.Hasil penelitian menunjukkan bahwa penerapan E-Court telah memberikan kemudahan administratif dan efisiensi waktu dalam penyelesaian perkara perdata. Namun, efektivitasnya masih belum optimal akibat keterbatasan infrastruktur jaringan di daerah, rendahnya literasi digital masyarakat hukum, serta pembatasan akses yang hanya dapat dilakukan oleh advokat terdaftar. Oleh karena itu, diperlukan penguatan regulasi, peningkatan kapasitas SDM, dan pemerataan infrastruktur teknologi agar sistem peradilan elektronik dapat berjalan lebih efektif dan inklusif di seluruh Indonesia.

The purpose of this research is to analyze the effectiveness of the implementation of the E-Court system in the settlement of civil cases in Indonesia and to identify the inhibiting factors and shortcomings in its judicial practice. The main issues examined concern the extent to which the E-Court system is able to realize the principles of a simple, fast, and low-cost judiciary, as well as the technical and juridical obstacles that arise in its application.The rapid development of information technology has driven digital transformation across various sectors, including the judicial system in Indonesia. The Supreme Court of the Republic of Indonesia has implemented the E-Court system as an innovation aimed at increasing efficiency, transparency, and access to justice through electronic administration and court proceedings. However, the implementation of this system still faces several challenges, such as limited human resources, technological infrastructure constraints, and unequal public understanding of digital systems.The research method used is juridical-normative empirical, with a statute approach. The data were obtained through library research on relevant regulations such as Supreme Court Regulation (PERMA) No. 3 of 2018, PERMA No. 1 of 2019, and PERMA No. 7 of 2022, as well as through case studies on the implementation of the E-Court system in several district courts.The results show that the implementation of the E-Court system has provided administrative convenience and time efficiency in the settlement of civil cases. However, its effectiveness has not yet been optimal due to network infrastructure limitations in several regions, low digital literacy among legal practitioners and the public, and access restrictions that limit submissions to registered advocates only. Therefore, strengthening regulations, enhancing human resource capacity, and ensuring equal technological infrastructure are necessary to make the electronic judicial system more effective and inclusive throughout Indonesia.
