EFEKTIVITAS PENERAPAN RESTORATIVE JUSTICE DALAM PENYELESAIAN KASUS KEKERASAN DALAM RUMAH TANGGA (KDRT)

Abstrak

Kekerasan Dalam Rumah Tangga (KDRT) adalah permasalahan sosial dan hukum dan berpengaruh besar terhadap kehidupan korban, pelaku, dan tatanan masyarakat. Penegakan hukum terhadap kasus KDRT selama ini cenderung menitik beratkan pada pendekatan retributif yang fokus pada penghukuman pelaku.Restorative justice atau keadilan restoratif hadir wujud penyelesaian perkara dengan musyawarah. Penelitian ini memiliki tujuan untuk menganalisis efektivitas penerapan restorative justice dalam penyelesaian perkara KDRT di Indonesia, dengan menelaah peran aparat penegak hukum,hambatan penerapan, serta efektivitas pendekatan ini dalam memberikan keadilan yang manusiawi. Metode penelitian yang digunakan adalah normatif.Penelitian menunjukkan bahwa restorative justice belum sepenuhnya diterapkan dalam sistem peradilan pidana KDRT. Namun demikian, penerapan pendekatan ini harus dilakukan dan tidak mengabaikan hak-hak korban dan tidak menimbulkan kebebasan hukum bagi pelaku.Oleh karena itu, diperlukan peraturan yang lebih jelas dan panduan teknis dalam penerapan keadilan restoratif pada kasus KDRT untuk menjamin perlindungan dan pemulihan yang menyeluruh bagi korban.

Domestic violence is a social and legal problem with widespread impacts on victims, perpetrators, and the social order. Law enforcement in domestic violence cases has tended to emphasize a retributive approach that focuses on punishing the perpetrator. Restorative justice exists as an alternative case resolution that focuses on restoring relationships between perpetrators, victims, and the community. This study aims to analyze the effectiveness of restorative justice in resolving domestic violence cases in Indonesia, by examining   the role of law enforcement officials, obstacles to implementation, and the effectiveness of this approach in providing humane justice. The research method used is normative. The results indicate that restorative justice has not been fully implemented in the domestic violence criminal justice system. However, the application of this approach must be carried out carefully to avoid neglecting the rights of victims and not resulting in legal freedom for perpetrators. Therefore, clearer regulations and technical guidelines are needed for the application of restorative justice in domestic violence cases to ensure comprehensive protection and recovery for victims.
