Abstrak

The Supreme Court continues to make regulatory reforms to improve the efficiency of the judicial process, as seen through the implementation of the e-court system, One-Stop Service (PTSP), and Simple Lawsuit procedures. Based on observations during an internship at the Medan High Court, these innovations are designed to make it easier for the public to pursue legal channels. However, the main challenge found is the low legal literacy of the community, causing many parties to feel that the litigation process is complicated, whereas the actual obstacle lies in a lack of understanding of the procedures. This is important because dispute resolution involving small losses is often considered disproportionate to the costs incurred if using the regular civil route. As a solution, the Supreme Court Regulation Number 2 of 2015 was issued and later updated through Supreme Court Regulation (PERMA) Number 4 of 2019 regarding Procedures for Simple Lawsuit Resolution. This procedure offers lower costs and an easier process, with a maximum material claim value limit of Rp500,000,000 and does not cover land disputes or cases in special courts. In addition, the parties are required to be present in person at the trial. Using a normative legal research method, this study formulates two main issues, namely: (1) the mechanism for resolving Simple Claims for parties within the same legal jurisdiction, and (2) the effectiveness of implementing this procedure in facilitating the public and assisting judges in speeding up the judicial process.
