Abstrak

Penipuan CPNS, semakin sering terjadi, karena bagi mayoritas penduduk menjadi PNS merupakan pekerjaan yang menjanjikan. Instrumen hukum acara pidana dan sistem pemidanaan secara formal mengatur proses penyelesaian perkara pidana. Diketahui dalam praktik digunakan sebagai alat represif saja. Prinsip utama penyelesaian tindak pidana melalui pendekatan restorative justice merupakan penyelesaian yang mampu menembus ruang hati para pihak yang terlibat. Penerapam restorative justice diterapkan dengan proses perdamaian antara pelapor dan terlapor. Atas dasar perdamaian, penyidik menindaklanjuti dengan melakukan gelar perkara untuk menghentikan penyidikan perkara. Pendekatan penelitian ini menggunakan pendekatan “socio-legal approch”. Jenis penelitian socio-legal. Lokasi penelitian Polresta Bengkulu. sumber data primer dan sekunder. Tujuan penelitian menganalisis penerapan dan hambatan restorative justice dalam penyelesaian tindak pidana penipuan penerimaan CPNS di Polresta Bengkulu. Kesimpulan penerapan restorative justice dalam penyelesaian tindak pidana penipuan penerimaan CPNS di laksanakan berdasarkan Surat Edaran Kapolri No 8 Tahun 2018 Tentang Penerapan Keadilan Restorative (Restorative justice) Dalam Penyelesaian Perkara Pidana Dan Peraturan Kapolri No 6 Tahun 2019 tentang penyidikan tindak pidana. Hambatan kurangnya personel Reskrim Polres Bengkulu yang menangani kasus penipuan, kurang kesadaran hukum masyarakat untuk ikut menjadi saksi, sulit menemukan bukti. Saran diharapkan menambah penyidik.

CPNS fraud is increasingly common, because for the majority of the population, becoming a civil servant is a promising job. The criminal procedure law instrument and the formal sentencing system regulate the process of resolving criminal cases. It is known that in practice it is only used as a repressive tool. The main principle of resolving criminal acts through the restorative justice approach is a settlement that is able to penetrate the hearts of the parties involved. The implementation of restorative justice is implemented through a peace process between the reporter and the reported. On the basis of peace, investigators follow up by conducting a case title to stop the investigation of the case. This research approach uses the "socio-legal approach" approach. The purpose of the study was to analyze the application and obstacles to restorative justice in resolving criminal acts of fraud in the recruitment of CPNS at the Bengkulu Police. The conclusion is that the application of restorative justice in resolving criminal acts of fraud in the recruitment of CPNS is carried out based on the Circular of the Chief of Police No. 8 of 2018 concerning the Application of Restorative Justice in the Settlement of Criminal Cases and Regulation of the Chief of Police No. 6 of 2019 concerning the investigation of criminal acts. Obstacles are the lack of personnel from the Bengkulu Police Criminal Investigation Unit handling fraud cases, lack of public legal awareness to become witnesses, difficulty in finding evidence. Suggestions are expected to increase investigators.
