THE PHENOMENON OF FATHERLESSNESS IN BROKEN HOME FAMILIES FROM THE PERSPECTIVE OF MURRAY BOWEN’S THEORY

Penelitian ini mengkaji praktik mediasi non-litigasi dalam penyelesaian konflik keluarga perspektif Peraturan Mahkamah Agung Nomor 1 Tahun 2016 dengan studi kasus di Desa Tlanakan, Kabupaten Pamekasan. Topik ini dipilih karena adanya kesenjangan antara regulasi mediasi formal dan praktik mediasi informal yang masih dominan di masyarakat. Penelitian ini menggunakan pendekatan hukum empiris dengan metode kualitatif melalui observasi, wawancara mendalam, dan dokumentasi. Hasil penelitian menunjukkan bahwa mediasi non-litigasi dilakukan oleh tokoh agama, tokoh masyarakat, dan keluarga melalui proses yang informal dan fleksibel berbasis kearifan lokal. Secara substantif, praktik ini mencerminkan prinsip itikad baik, musyawarah, dan perdamaian yang sejalan dengan ketentuan formal. Namun secara prosedural, praktik ini belum memenuhi standar hukum karena tidak adanya mediator bersertifikat, jaminan netralitas, serta kekuatan hukum yang mengikat. Penelitian ini menyimpulkan bahwa mediasi non-litigasi efektif secara sosial tetapi lemah secara yuridis, sehingga diperlukan integrasi antara praktik lokal dan hukum formal.
This study examines the practice of non-litigation mediation in resolving family conflicts from the perspective of Supreme Court Regulation Number 1 of 2016, focusing on Tlanakan Village, Pamekasan Regency. The topic is selected due to the gap between formal mediation regulations and the persistence of informal mediation practices in society. This research employs an empirical legal approach with a qualitative method, using observation, in-depth interviews, and documentation as data collection techniques. The findings indicate that non-litigation mediation is primarily conducted by religious leaders, community figures, and family elders through informal and flexible processes based on local customs. Substantively, the practice reflects principles of good faith, deliberation, and peaceful settlement in line with formal mediation standards. However, procedurally, it lacks certified mediators, neutrality guarantees, and legally binding outcomes. The study concludes that non-litigation mediation is socially effective in maintaining family harmony but remains weak in terms of legal protection, particularly for vulnerable parties. Therefore, an integrative approach is needed to align local mediation practices with formal legal frameworks.
