EFEKTIVITAS PENUNTUTAN OLEH KEJAKSAAN DALAM SISTEM PERADILAN PIDANA INDONESIA

Abstrak

Efektivitas penuntutan oleh Kejaksaan dalam menegakkan hukum pidana di Indonesia merupakan aspek krusial dalam proses sistem peradilan pidana. Pada penelitian ini, penulis menganalisis faktor- faktor yang memengaruhi keberhasilan atau kegagalan penuntutan dengan menggunaan metode penelitian yang digunakan bersifat kualitatif dengan pendekatan yuridis-normatif. Hasil penelitian menunjukkan bahwa efektivitas penuntutan didasarkan pada beberapa aspek, yakni kualitas Sumber Daya Manusia, profesionalisme, integritas, penrapan prosecutorial discretion, serta sinergitas antar lembaga penegak hukum. Oleh karena itu, penulis menyimpulkan kualitas proses hukum yang mencerminkan keadilan substantif merupakan faktor terlaksananya efekktifitas penuntutan. Dengan demikian, Reformasi kelembagaan, koordinasi lintas lembaga, dan penguatan mekanisme pengawasan internal menjadi faktor penunjang utama tercapainya tujuan sistem peradilan pidana yang efektif dan berkeadilan.

The effectiveness of prosecution by the Attorney General's Office in enforcing criminal law in Indonesia is a crucial aspect of the criminal justice system. In this study, the author analyses the factors that influence the success or failure of prosecution using a qualitative research method with a legal- normative approach. The results of the study show that the effectiveness of prosecution is based on several aspects, namely the quality of human resources, professionalism, integrity, the application of prosecutorial discretion, and synergy between law enforcement agencies. Therefore, the author concludes that the quality of the legal process that reflects substantive justice is a factor in the effectiveness of prosecution. Thus, institutional reform, inter-agency coordination, and strengthening internal oversight mechanisms are the main supporting factors for achieving the objectives of an effective and fair criminal justice system
